Welcome to the email SMTP application (the “Service”) owned and operated by Texas Solar Guys, LLC (“Company,” “we,” “us,” or “our”).
By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
1. Account Registration and Security
- Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
- Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.
- Credentials: You are entirely responsible for maintaining the confidentiality of your SMTP credentials, API keys, and account passwords. Any activity occurring under your account is your sole responsibility.
2. Acceptable Use and Anti-Spam Policy
Our SMTP Service is designed for legitimate transactional and marketing email delivery. We maintain a zero-tolerance policy for spam and malicious activities.
You strictly agree NOT to use the Service to:
- Send Unsolicited Emails (Spam): Send bulk emails to recipients who have not explicitly opted-in to receive communications from you, in violation of the CAN-SPAM Act, GDPR, or other applicable global anti-spam laws.
- Distribute Harmful Content: Transmit malware, viruses, phishing schemes, scams, or any content that is defamatory, illegal, or infringes on third-party intellectual property rights.
- Spoof or Misrepresent: Impersonate any person or entity, forge email headers, or intentionally hide the origin of any email transmission.
- Exceed Thresholds: Maintain high bounce rates, spam complaint rates, or blocklist statuses that threaten the IP reputation of our delivery infrastructure.
3. Service Availability and Modifications
- “As-Is” Delivery: We strive for high deliverability, but we do not guarantee uninterrupted service, perfect inbox placement, or 100% uptime. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
- Updates: We reserve the right to modify, suspend, or discontinue features of the SMTP application at any time, with or without notice.
4. Fees, Billing, and Refunds
- Subscription Pricing: Access to certain tiers or volumes of email delivery requires payment of subscription fees. All current pricing tiers are detailed on our pricing page.
- Overages: If your account exceeds your allocated monthly or daily email sending limits, you will be billed for overages at our standard rates.
- Refund Policy: Except as explicitly stated otherwise or required by local law, all fees paid are non-refundable.
5. Suspension and Account Termination
- Our Right to Terminate: We reserve the right to immediately suspend or terminate your API access and account without notice if we detect a breach of Section 2 (Anti-Spam), excessive bounce rates, or any violation of these Terms.
- Your Right to Terminate: You may cancel your subscription or delete your account at any time through your dashboard panel.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Texas Solar Guys, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data loss, email delivery failures, or blacklisting of your corporate domains arising out of your use of the Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
8. Changes to These Terms
We may update these Terms from time to time. If we make material modifications, we will notify you by updating the “Last Updated” date at the top of this page or by sending an email notification to the address associated with your account.
